CSI Professionals shares good news on recent Green Card Employment-Based petition results, returning to approvable cases without an interview. As a result of our government’s Covid-19 safety measures, USCIS is now re-implementing “waiver of interview” on straight out approvable i485 application on a case to case basis.
As it appears, to avoid a drastic backlog, USCIS is relaxing the green card interview requirements for employment-based green card applicants during the COVID-19 pandemic.
While there has been no formal U.S. Government announcement, there are still some potential good news! There are some reports that U.S. Citizenship and Immigration Services (USCIS) has been approving some family and employment-based adjustment of status cases without first scheduling an interview. In legal terms, USCIS is “waiving” the in-person interview requirement for some, using only written evidence (a form of RFE-request for evidence) to approve the applicant for U.S. residence (a green card).
This waiver isn’t, unfortunately, something the approved applicants asked for. Nor can you ask for an interview waiver, as much as you might want to. Sometimes, it may happen – and sometimes, it may not. This is why it is worth checking your visa status now and again, to see if there have been any changes and whether your interview has been waived or not. Do not worry, our office is keeping an eye on your statuses, consistently!
Also, USCIS has been issuing requests for evidence, asking green card applicants to mail their medical examination forms to USCIS directly. At times, asking for an updated photo, certificate of continuing employment offer from the petitioner. This move may indicate the very real possibility that USCIS is considering waiving the interview requirement for other green card applicants (such as marriage-based applicants), at least on a case-by-case basis or as long as there are no lapses or violation of immigration status, from the past until the application has been adjudicated. This is one reason, why we emphasize on maintaining status all the time, even during the non-immigrant to pending immigrant processes.
With good luck and strong faith, you’ll receive an approval for permanent residence not long after the USCIS has received and reviewed your materials.
We at CSI, recall the old process from 2018 below with a high percentage of cases being approved on EB2 and EB3’s without the need for an interview. This was replaced by USCIS during the time of President Trump’s Administration.
