“We should have passed the DREAM Act a long time ago,” President Obama insisted. He has been fighting to pass the DREAM Act to prevent the removal of illegal immigrants who came to the U.S. when they were children. Since Congress has not yet passed the DREAM Act, The President has announced that he is expanding the eligibility criteria for “deferred action” to include individuals who would be protected by the Act.
This policy was announced on June 15, 2012. You may be qualified if you meet the following criteria:
1. You arrived in the United States before your 16th birthday.
2. You have continuously lived in the United States for 5 years.
3. You have not been convicted of felony, a significant misdemeanor or multiple misdemeanors, or pose a threat to national security.
4. You were less than 31 years old on June 15, 2012.
5. You are in school, graduated in high school, have obtained GED or are an honorably discharged veteran.
Individuals who receive deferred action may apply for employment authorization from USCIS provided they can demonstrate an economic necessity for their employment. Deferred action is granted for a period of two years and is renewable in two year increments for as long as the policy remains in place.
Although individuals currently in Removal Proceedings or with outstanding removal or deportation orders can apply for deferred action now, USCIS has announced that they will not have procedures in place to accept and process affirmative applications (i.e., from people who are not in Removal Proceedings or with outstanding Removal or Deportation orders) for approximately 60 days. This means that individuals wanting to file affirmative applications will have to wait until approximately the middle of August, 2012. Individuals currently in detention and/or in removal proceedings should consult with their attorney regarding this new policy.
