On June 11, 2012, H-1B cap for the fiscal year 2013 has been reached as of June 11, 2012. In addition, on June 7, 2012, USCIS received more than 20,000 H-1B petitions on behalf of persons exempt from the cap under the advanced degree exemption. The USCIS’ H-1B quota has been achieved, quite fast.

Despite this fast outcome, we remain hopeful. It wasn’t as bad as previous years when H1-B would close on the first day of filing in the month of April. Nonetheless, we look at the brighter side and it gives us an opportunity to understand these “obstacles and trials” to plan ahead. However, even if you were trapped in the cap, there may be ANOTHER OPTION for you. You may qualify for H3 which is in some ways similar to H-1B. But H3 is a training visa for people who would like to undergo a professional on-site training with aUScompany. Such a training visa can be requested for up to two years.  On a lighter note, President Obama has announced that he is expanding the eligibility criteria for “deferred action” to include individuals who would be protected by the DREAM Act.

This new policy was announced on June 15, 2012. However, USCIS has announced that they will not have procedures in place to accept and process affirmative applications for approximately 60 days. This means that applications for individuals who are not in detention and who have never been in removal or deportation proceedings cannot be filed until approximately the middle of August, 2012. Individuals currently in detention and/or in removal proceedings should consult with their attorney regarding this new policy.
