As you may realize, we can see that the trend of demand for H-1B visa is increasing. In fact, for the FY 2012, we know that the full 65,000 quota was reached by November 22, 2011; whereas for the FY 2011, full 65,000 quota was reached on January 26, 2011. Some people stress that this is evidence of recovery for the economy; on the other hand, others mention that this had been just temporary and artificial due to the expansion of students’ OPT by 17 months a few years ago.
Moreover, the denial rate on H1B of 2004 was 11 percent while the rate of 2011 was 17 percent. In addition, the request for evidence rates in 2004 was 4 percent and that of 2011 was 26 percent, which was the highest in recent years. The reasons why it happened are that the statutory changes were implemented and major decisions were issued.
